Why You Have To Watch Out For Insurance Companies After Car Accidents

The harsh reality is that the big, strong and powerful insurance companies often try to force injured parties into accepting a lower settlement for their injuries than they truly deserve in their injury case. I know you may find this hard to believe, but insurance companies will try to get you to accept a lesser amount for your injuries than you deserve. What you are dealing with is that ‘your good neighbor’ whose ‘on your side’ has his ‘good hands’ in your money pocket. 

Here is why you have to watch out for insurance companies and what to do about it:

You are injured in a car wreck and see a doctor a few times. You miss work, but you feel like you are getting better. So, you call the insurance company and say ‘let’s settle’. You sign a release and take the money. A week or two later, you can’t get out of bed and are in excruciating pain. You go to the doctor, and he says you have a herniated disc from the car wreck. He tells you that you need surgery and will be off work for three months. You call the insurance company to tell them and they laugh and say ‘Sorry, but you signed a release and we don’t owe you another dime! Does this sound unbelievable? Think it won’t happen? WRONG!! It happens!

Unfortunately, I have people call me with stories just like this, and I have to tell them “Sorry, if you signed a release, there is probably nothing I can do for you!” You should have gone to see a lawyer first!!!! My advice to everybody is…Do NOT rely on the insurance company to help you. Their adjusters are not working to help you. They are working to for the person or company that signs their paycheck and that’s NOT you. Do what’s best for YOU…talk to a lawyer!

Taxpayers With IRS Problems Are Always Looking Over Their Shoulder For The IRS!

Once you owe the IRS money, they become very aggressive in their collection attempts. One of the more common collection methods the IRS uses is the LEVY!

They will use either a Bank Levy or a Wage Levy. If you're lucky enough to still have a bank account, the Bank Levy allows the IRS to present your bank with a piece of paper that requires the bank to immediately withdraw all the money you owe the IRS.

Many times these Bank Levies are wrong, but the IRS doesn't care and it's up to you to correct the problem. Meanwhile, the checks you've written are bouncing all over town.

The worst thing about the IRS Bank Levy is that, if your name happens to be on the account, it may capture your children's, parent's, girlfriend's or spouse's bank account. Even if it's just on there for convenience. 

The IRS doesn't care, they just want to get paid 
and they don't care who pays your taxes.

After the bank has cleaned out all checking and savings accounts with your name on them, they send the money to the IRS. You should take this as notice that the IRS will issue another Bank Levy against you in the future, to satisfy any remaining amounts owed to them.

It's kind of like hitting the lottery for the IRS. Once they find out how to get your money, they will continue taking your money by issuing more bank levies.

As Bad as The Bank Levy Is, The Wage 
Levy (Garnishment) Is Much Worse!

The bank levy is a one shot deal. Meaning that the IRS must continue to issue a new Bank Levy every time they want to clean out your bank account. The Wage Levy (Garnishment) is much, much worse. It's designed to bring you to your knees.

The Wage Levy is issued to your employer and it instructs the employer to immediately start withholding ridiculously high amounts of money to pay old tax liabilities in addition to the normal taxes being withheld.

Wage Levies often result in you only receiving a few hundred dollars per pay period. This usually makes it impossible to pay your bills and eat. The IRS knows that Wage Levies cause all types of harm to you and your family, but they mail out thousands every day.

Having IRS Problems Gets Old!

There can be no real rest and relaxation until your IRS problem is completely solved. It's hard to keep a good job or get your credit report cleaned up when the IRS continues to issue Federal Tax Liens and Wage Levies.

Without a bank account it's difficult to cash your checks or even pay your monthly utility bills. Even if you're lucky enough to have a bank account, you have to always worry about the IRS wiping out all of the money in the account without notice.

Why the IRS Takes Payroll Tax Issues So Seriously

The IRS looks at employers who don’t pay their employees’ payroll taxes as stealing, plain and simple. Payroll Taxes are referred to as Trust Fund Taxes, because in essence you have been “entrusted” with money belonging to your employees. It’s your job to withhold a portion of money they’ve earned to pay their income tax and their share of FICA (social security and Medicare) and pay it to the U.S. Treasury. 

Your employees are the ones who owe the money to the government - you are simply the delivery person. When you don’t pay your employees’ payroll taxes, it’s considered THEFT. In the eyes of the IRS, the money was never yours in the first place. So here’s... 

Why the IRS Would Rather Close Your Business 
If You Have Payroll Tax Problems 

If you haven’t paid your payroll taxes, the IRS is NOT usually interested in working out a payment plan. Experience has shown them that your Payroll Tax problems are likely to get bigger - as long as your business is allowed to remain open. Forcing you to close your business instantly stops this possibility. 

So it’s very important you know – when the IRS discovers you have a payroll problem, they are usually pre-determined to shut your business down quickly. They will have serious doubts as to your abilities to pay new payroll taxes when you still owe old payroll taxes. It would be easier for them to simply shut the business down, and deal with the issues of getting their money from the “responsible parties.” 

Plus, if the IRS Revenue Officer were to agree to a payment plan, and you ended up NOT paying in the end, it creates an even more embarrassing situation for the Revenue Officer, since he was “duped” into agreeing to a plan. It’s easier just to shut you down. 

Therefore – if you want to keep your business open, you need a professional third party speaking on your behalf, basically convincing the Revenue Officer that your business would be better off alive than dead...and that they are MORE likely to get the money if they work with you. Does Your Business Have A Payroll Tax Problem?

Charleston, West Virginia IRS & Tax Attorney, Jeffrey T. Jones Discusses Why You Must End Your Payroll Tax Problem Today Or…The IRS Could Shut Your Business Down! 

Owing the IRS isn’t like owing a credit card company or even a bank. They have special powers granted to them by the U.S. Government to literally reach into your bank account and take your money. They can also take your real estate, social security benefits, 401(k)’s, IRA’s, cars, boats, houses, accounts receivable, cash loan value of your life insurance...even commissions owed to you, all just to satisfy a tax debt. And in the case of tax evasion or fraud, they can even put you in jail.

But you must understand – there’s a MAJOR difference between not paying personal taxes and not paying payroll taxes:
  • The IRS can padlock the front doors of your business without a court order.
  • Payroll taxes CANNOT be discharged in bankruptcy.
  • Owners, partners, corporate officers are held PERSONALLY liable for unpaid payroll taxes.
  • The IRS can seize your PERSONAL assets to satisfy a payroll tax debt.
  • Not paying your payroll taxes COULD be considered a Federal Crime if the IRS can prove you willfully didn’t file or didn’t pay.
In some cases the IRS would rather shut your business down and liquidate your assets than give you the opportunity to NOT pay even more payroll taxes. Are you starting to see what a big deal this is? If you are considered “responsible” for paying payroll taxes for your company and you don’t pay them, the IRS will eventually assess the Trust Fund Recovery Penalty (TFRP) against you. 

But for now, let this sink in: if you’re found to be a “responsible person”, you could be held PERSONALLY liable for payroll taxes! So the #1 question you need to ask yourself is...

Would The IRS Consider Me “Responsible?”

It could be as simple as answering this question: “Have you ever signed a payroll check?” If so, chances are good you’re on the hook. However it may not be as cut and dry as this. The IRS has two major tests to determine if you are a “responsible person”: 

1) Whether the party against whom the Trust Fund Recovery Penalty is proposed had the duty to account for, collect, and pay over payroll taxes; and

2) Whether he or she willfully failed to perform this duty.

As you can see, this is a pretty vague test. Because of this, the IRS has their work cut out for them trying to determine who is “responsible” for not paying payroll taxes. There’s usually no “cut and dry” answer (in some cases, even the offending company’s CPA’s and lawyers have been held liable)!

If your company is having a payroll tax problem, and you’re unsure if you could personally be held liable by the IRS in this situation, call me. There’s no sense losing sleep at night, not knowing if the IRS is going to come after you. Besides, you owe it to yourself and your family to be protected from the IRS!
